​General Terms and Conditions (T&Cs) of Pilates Social Collective LLC (PSC)
1. Scope of Application

These terms govern the use of services, classes, and facilities provided by PSC, including bookings through the Eversports platform.

By booking or attending a session, clients accept these terms.
2. Liability Waiver

Clients participate in all classes and activities at their own risk.

PSC, its owners, employees, and instructors are not liable for personal injuries, accidents, or health issues arising during or after participation in activities.

Clients are responsible for consulting a medical professional before engaging in fitness activities, particularly if they have pre-existing conditions.
3. Assumption of Risk

Clients acknowledge that physical activities carry inherent risks, including the potential for injury. Participation is voluntary, and clients accept full responsibility for their health and safety.
4. Personal Belongings

PSC is not responsible for loss, theft, or damage of personal items. Clients are encouraged to keep valuables with them at all times.

Lockers are provided, but their use does not constitute liability on the part of PSC for stored items.
5. Code of Conduct

Clients must follow studio guidelines, including arriving on time, respecting other participants, and using equipment safely.

PSC reserves the right to deny access or cancel memberships for clients who fail to adhere to the code of conduct.
6. Cancellation and Refunds

Clients may cancel bookings in accordance with PSC's cancellation policy (12-hour notice for class cancellations).

Refunds or credits are not provided for missed classes without proper cancellation notice unless otherwise stated.
7. Medical Information

Clients must disclose any medical conditions, injuries, or limitations to the instructor before class.

PSC may request a medical certificate confirming fitness to participate in classes if necessary.
8. Pregnancy and Postpartum

Clients who are pregnant or postpartum are required to inform instructors and may be required to provide medical clearance.

PSC offers specialized classes for these clients but cannot guarantee suitability for all participants without prior consultation.
9. Memberships and Packages

Memberships and class packages are non-transferable and non-refundable unless stated otherwise.

Expiration dates apply to class packages, and unused sessions cannot be carried forward unless agreed in writing.
10. Right to Modify Services

PSC reserves the right to modify class schedules, instructors, or services. Reasonable notice will be provided when possible.

In case of unforeseen circumstances (e.g., instructor illness, weather), PSC may cancel classes without liability.
11. Privacy and Data Protection

Client personal data is collected and processed in accordance with the PSC Privacy Policy and the Eversports Privacy Policy.

Data is used for service delivery, communication, and operational purposes only.
12. Governing Law and Jurisdiction

These terms are governed by Swiss law. Any disputes shall be resolved exclusively in the courts of Basel, Switzerland.
13. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Acceptance of Terms

By booking, attending classes, or using PSC facilities, clients confirm that they have read, understood, and agreed to these terms and conditions.
15. Emergency Situations

PSC is not liable for emergencies occurring on the premises. Instructors will provide assistance within their abilities, but clients are responsible for their medical needs.
